These terms cover your use of miscellaneaetc.com and anything you buy from us, online or in person. By using the site or placing an order, you're agreeing to them. If you don't agree, please don't use the site.

This site is operated by Miscellanea LLC, doing business as Miscellanea, Etc., an Illinois limited liability company based in Chicago, Illinois. "We," "us," and "our" refer to that business. "You" refers to you, the person using the site or buying from us.

Using the site

You need to be at least 18 and able to enter a contract to buy from us. You agree not to use the site for anything unlawful, not to scrape or copy it for a competing business, and not to interfere with how it runs. We can refuse service or cancel an order if we need to.

Our pieces

Everything we sell is vintage and one-of-a-kind, which means each piece is unique, previously owned, and sold as-is with the character it has earned. We describe condition as accurately as we can and photograph each piece to show it honestly. Colors can shift between screens, and wood tone, patina, and finish read differently in person than in photos.

Because inventory is one-of-a-kind, availability is first come, first served. Adding a piece to your cart doesn't reserve it. A piece is yours when your order is paid and confirmed.

Holds

We hold pieces for designers and clients from time to time. A hold isn't a purchase and doesn't guarantee availability unless we've confirmed it with you in writing.

Pricing and errors

Prices are in US dollars and can change without notice. We do our best, but pricing, dimensions, and availability errors happen. If a piece is listed at the wrong price or is no longer available, we'll contact you and either correct the order with your approval or cancel it and refund you in full.

Payment and sales tax

We accept the payment methods shown at checkout. Illinois sales tax is applied where required. Trade customers with a valid resale or exemption certificate on file with us can purchase tax-exempt. Trade members also receive 10% off retail pricing.

Shipping, delivery, and risk of loss

Shipping and delivery are covered in our Shipping Policy, which is part of these terms. Title and risk of loss pass to you on delivery. Estimated delivery windows are estimates, not guarantees, and we aren't responsible for carrier delays outside our control.

Before you buy, please measure your doorways, stairwells, elevators, and the spot the piece is going. Vintage furniture doesn't come apart the way flat-pack does. If a piece can't be brought in, redelivery or return charges are yours.

Returns

All sales are final. Our Return and Refund Policy explains the exceptions for transit damage and misdescribed pieces, and it's part of these terms.

Our content

The photography, writing, design, and layout on this site belong to us and are protected by copyright. The Miscellanea, Etc. name and logo are our trademarks. You're welcome to share our images on social media with credit and a link back. Please don't use our photography or copy for resale listings, advertising, or any commercial purpose without written permission.

Feedback and submissions

If you send us ideas, photos, or comments, we can use them without obligation to you. Please only send us photos you have the right to share.

Third-party links and services

The site links to and relies on third-party services, including our payment processor, shipping carriers, and appointment booking. We're not responsible for their content or practices, and your use of them is governed by their own terms.

Disclaimer and limitation of liability

The site and everything on it are provided as-is and as-available, without warranties of any kind, express or implied, to the fullest extent the law allows. This includes implied warranties of merchantability and fitness for a particular purpose.

Vintage pieces are sold as-is. Older items may not meet current safety standards. Vintage lighting and electrical pieces should be inspected and rewired by a licensed electrician before use unless we've noted that they've already been rewired. Some older finishes may contain lead paint. Please use your judgment about placing vintage pieces in homes with small children.

To the fullest extent the law allows, our total liability for any claim related to the site or an order is limited to the amount you paid for that order. We aren't liable for indirect, incidental, or consequential damages.

Indemnification

You agree to hold us harmless from claims arising out of your misuse of the site or your breach of these terms.

Governing law

These terms are governed by the laws of the State of Illinois, without regard to conflict of law rules. Any dispute will be handled in the state or federal courts located in Cook County, Illinois.

Changes

We may update these terms. The version posted here at the time of your order is the one that applies to it.
